University of New Mexico Birth Parent Adoption Rights

In today's adoptions, an expectant parent plays the central role in deciding on what type of an adoption plan is best for them and their child, while the expectant parent is cared for throughout the adoption planning process. An expectant parent considering an adoption plan, has the right to:

1.Be treated with dignity and respect, not judgment or criticism.

2.Explore all options in a non-directive, non-coercive environment, including parenting and all levels of openness in adoption.

3.Be fully informed about legal rights during the decision-making stage.

4.Choose the prospective adoptive family.

5.Develop an adoption plan with your counselor and the adoptive family.

6.Spend time in the hospital with the baby.

7.Make the decision about adoption after the birth of the baby. Planning for adoption does not make it a final decision, and an adoption plan does not become definite until legal papers are signed releasing birth parents rights after the birth.

8.Sign relinquishment papers when the birth parent is ready.

9.Have all questions answered honestly and completely, at any stage.

10.Have the birth parents relationship with their child acknowledged and their grief and loss recognized.

11.Receive post-placement support.

There is no easy solution to an unplanned pregnancy. Each option with an unexpected pregnancy is hard and has its own difficulties. The birth parent can empower themselves by getting as much information as they can get about their options. So they can carefully and weigh each option to be able to make the right decision for them and their baby.
