THANKS ONCE AGAIN TO EACH OF YOU! ! Yesterday morning (3/8/11) HB 125 (adoption services) and HB 158 (adoption advertising) got a “do pass” in the Senate Public Affairs. They are now being scheduled for our last, possibly most rigorous committee SENATE JUDICIARY. They could be heard anytime in the next few days so please contact members of Senate Judiciary promptly asking them to vote yes on these bills. The end is close!
RECAP OF THE PROBLEM Over the last ten years, adoption in New Mexico has fallen prey to profit-driven, out of state adoption businesses not licensed here. NM licensed professionals and vulnerable residents involved in an adoption process often face a serious crisis. These Predatory adoption businesses attract unsuspecting birth parents and adoptive parents to them through large-scale advertising. They provide informal but costly adoption services for months. They wait until the last moment to contact NM licensed professionals to furnish the minimum legally required adoption service. With much hanging in the balance, we discover that those we represent may have been misinformed of the facts involved in their adoption, and their rights and requirements in a New Mexico adoption process during a most emotionally vulnerable time.
HB125 (Adoption Services) expands the definition of adoption service and requires NM licensure for those who provide those services within our state. It would also require an accounting to and approval from a NM Court for disbursements paid on behalf of an adoption before a NM child may be moved to another state, (provides more jurisdiction). It also provides for more penalties for violators.
HB 158 (Adoption Advertising) would require that out of state adoption businesses not licensed or permitted to provide adoption services here to say so in their advertisements. The public is not able to determine who is a legitimate adoption service provider in this advertising. It also provides for more penalties for violators.
1) Please contact Senator Richard Martinez, Chair of Senate Judiciary (below). Ask if he can help HB158 and HB125 sponsored by Representative Al Park be heard together (as soon as possible of course). The bills were meant to be heard together. (Briefly there wasn’t a quorum when HB125 was voted on and had to go back this afternoon (for a sure YES vote) but causing a possible day’s lag behind HB158.
2) Call or email the members of Senate Judiciary (below). Ask them to VOTE YES on House Bills HB125 -Adoption Services and HB158 -Adoption Advertising. Attend this committee meeting to stand in support of it.
