Ethical Adoption Practice in New Mexico, Bills to be Heard by Senate Public Affairs Committee

THANKS ONCE AGAIN TO ALL OF YOU, Bills HB 125 and HB 158 passed the House and is now assigned to Senate Public Affairs Committee and will probably be heard Thursday or Friday (March 3rd or 4th ) of this week (or Tues March 8th) so we need to respond quickly.

Let the Senators below know how you’re connected to the adoption community and why ethical adoption practice is important to you. Paste pictures of your children into your emails or speak passionately of how important it is to you that birth parents, adoptees and adoptive parents are supported in an ethical, fully legal adoption process in our State.

Thank you again for your commitment, passion & action needed to turn these bills into New Mexico law. We’re getting closer! Time is getting short! We need your calls and emails to keep coming in order to get these bills passed. To see the full legislation go to http://www.nmlegis.gov/

RECAP OF THE PROBLEM Over the last ten years, adoption in New Mexico has fallen prey to profit-driven, out of state adoption businesses not licensed here. NM licensed professionals and vulnerable residents involved in an adoption process often face a serious crisis. These Predatory adoption businesses attract unsuspecting birth parents and adoptive parents to them through large-scale advertising. They provide informal but costly adoption services for months. They wait until the last moment to contact NM licensed professionals to furnish the minimum legally required adoption service. With much hanging in the balance, we discover that those we represent may have been misinformed of the facts involved in their adoption, and their rights and requirements in a New Mexico adoption process during a most emotionally vulnerable time.

HB125 (Adoption Services) expands the definition of adoption service and requires NM licensure for those who provide those services within our state. It would also require an accounting to and approval from a NM Court for disbursements paid on behalf of an adoption before a NM child may be moved to another state, (provides more jurisdiction). It also provides for more penalties for violators.

HB 158 (Adoption Advertising) would require that out of state adoption businesses not licensed or permitted to provide adoption services here to say so in their advertisements. The public is not able to determine who is a legitimate adoption service provider in this advertising. It also provides for more penalties for violators.

1) Call or email the 8 members of Senate Public Affairs Committee (below). Ask them to VOTE YES on House Bills HB125 -Adoption Services and HB158 -Adoption Advertising. Include your name and your address. Attend this committee meeting to stand in support of these bills.
